\nEU Energy Logo Service<\/a> enables Client to receive <\/span>1WorldSync EU<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

Energy Logos<\/a>, 1Worldsync EU
\nEnergy Labels<\/a> and Product Fiche<\/a>
\nin real-time from 1Worldsync for publishing purposes to meet EU regulations and to educate
\nshoppers regarding energy-efficient products in select qualifying product categories.<\/p>\n

DataSource Subscription Requirement<\/h2>\n

For Clients wanting to receive structured EU energy content in their DataSource Feeds and\/or for
\nClients that desire us to build and deliver EU energy content for Non-stocked
\nSKUs<\/a>, Client must have an active DataSource Subscription or DataSource Content Creation
\nand Delivery Subscription in order for 1WorldSync to perform this service. The deliverables for
\n1WorldSync\u2019s EU Logo Service will be subject to the Subscription
\nConfiguration<\/a> of the Client\u2019s DataSource Subscription or DataSource Content Creation and
\nDelivery Subscription (i.e. markets, languages, categories, maximum number of Products\/SKUs
\ncovered, etc.).<\/p>\n

Permitted Usage<\/h2>\n

1WorldSync\u2019s EU Energy Logo Service may be used and published on websites fully owned and
\ncontrolled by Client, as listed in the Permitted Usage section of the Order Form.<\/p>\n

Client Responsibilities<\/h2>\n

Client will implement 1WorldSync\u2019s real-time JavaScript code onto their Product Page, and in
\nother locations on the Permitted Usages as required. Client shall provide 1WorldSync with the
\nManufacturer Part Number, Manufacturer Name, and other information as required for each Product
\nto display the available EU Energy data from the 1WorldSync Logo service.<\/p>\n

1WorldSync Responsibilities<\/h2>\n

Based on values passed within Client\u2019s implementation of the real-time JavaScript code and
\n1WorldSync\u2019s proprietary technologies and know-how, 1WorldSync will use commercially reasonable
\nefforts to provide the 1WorldSync EU Energy Logo Service. 1WorldSync will aggregate and prepare
\nthe energy efficiency data available from Manufacturers and the EPREL database within 1WorldSync
\ndatabase for a qualifying Product within the Market in the form of the 1WorldSync EU Energy Logo
\nHover Window which will automatically display the applicable 1WorldSync EU Energy Label when a
\nuser interacts with the 1WorldSync EU Energy Logo and the 1WorldSync Product Fiche or EPREL
\nProduct Information Sheet where applicable. The 1WorldSync EU Energy Logo Services will be
\nprovided when (i) the Products selected by Client and available on the Client Permitted Usages
\nmeet the criteria of the EU Energy Regulations, 1WorldSync EU Energy Logo Service and (ii)
\n1WorldSync has energy efficiency data and product information readily available within the
\n1WorldSync database for the European markets.<\/p>\n

1WorldSync Review<\/h2>\n

Client acknowledges and agrees that 1WorldSync does not intend to, and will not be required to,
\nedit, or review the 1WorldSync EU Energy Logo Service deliverables (i.e. the 1WorldSync EU
\nEnergy Logos and the 1WorldSync EU Energy Labels) for accuracy, sufficiency or compatibility
\nwith any regulations, laws, directives, governmental guidelines. 1WorldSync will use
\ncommercially reasonable efforts to update the 1WorldSync EU Energy Logo Service and deliverables
\n(i.e. the 1WorldSync EU Energy Logos and the 1WorldSync EU Energy Labels) based on changes made
\nto the EPREL database and\/or based on supplier submissions and data feeds, and the availability
\nthereof.<\/p>\n

Reporting<\/h2>\n

Upon Client reasonable request, 1WorldSync will provide a report reflecting the following metrics
\nfor the previous month: (i) the number of 1WorldSync EU Energy Logo impressions per Client
\nPermitted Usage; (ii) the number of resulting 1WorldSync EU Logo Hover Windows per Client
\nPermitted Usage; (iii) statistical information on the amount of time users interact with the
\n1WorldSync EU Energy logo Hover Window (\u201c1WorldSync Report<\/strong>\u201c), and (iv) the
\nattribute coverage rates for the 1WorldSync EU Energy Label, 1WorldSync Product Fiche, and EPREL
\nProduct Information Sheet.<\/p>\n

Restrictions on the Use<\/h2>\n

Client shall use the 1WorldSync EU Energy Logo Service in accordance with any applicable
\nmanufacturer or governmental\/regulatory entities guidelines at all times, and Client is solely
\nresponsible to obtain and abide by such guidelines.<\/p>\n

Client use of the 1WorldSync EU Energy Logo Service is intended for Client internal business
\npurposes only (i.e. inclusive of use on Client websites as listed in the Permitted Use section
\nof the Order Form, and strictly limited to the 1WorldSync EU Energy Logo Service and display of
\n1WorldSync EU Energy Logo, 1WorldSync EU Energy Logo Hover Content, and 1WorldSync Product Fiche
\non Client Permitted Usages.<\/p>\n

Client shall not license, sublicense, sell, resell, transfer, assign, distribute or otherwise
\ncommercially exploit or make available to any third party the 1WorldSync EU Energy Logo Service,
\nthe 1WorldSync EU Energy Logo Hover Content, the 1WorldSync Product Fiche or the 1WorldSync EU
\nEnergy Logo in any way.<\/p>\n

Client shall not modify or make derivative works based upon the 1WorldSync EU Energy Logo
\nService, the 1WorldSync EU Energy Logo Hover Content, the 1WorldSync Product Fiche or the
\n1WorldSync EU Energy Logo or attempt to reverse engineer the 1WorldSync EU Energy Logo Service.<\/p>\n

Data<\/h2>\n

By using the 1WorldSync EU Energy Logo Service, Client agrees that 1WorldSync may use cookies,
\nweb beacons or other technologies to collect data related to a- user\u2019s behavior on Client
\nPermitted Usages. Client grants 1WorldSync a non-exclusive, perpetual, worldwide, and
\nirrevocable right and license to collect, use, create derivative works from, and disclose data
\nderived from the 1WorldSync EU Energy Logo Services and to allow 1WorldSync third-party data
\npartners to do the same. In addition, 1WorldSync may use the data provided by Client, including
\nBrand, manufacturer part number and other attributes to create \u2013 deliverables as required under
\nthis Agreement. Client agrees to obtain all rights and permissions necessary, if any, including
\nmaking any notifications to its users as may be necessary, for 1WorldSync and its affiliates to
\nmonitor the Permitted Usage in order to collect and use data, create reporting based on, or
\nmonitor website traffic, statistics, advertisements, \u201cclick-throughs\u201d and\/or other activities,
\nand 1WorldSync and its affiliates may use cookies, web beacons, and other technologies to
\ncompile and use anonymous statistics about Client\u2019s users.<\/p>\n

1WorldSync Energy Logo Service
\nTermination<\/span><\/strong>. Upon termination of the Agreement for any reason, Client
\nshall cease all uses of the 1WorldSync EU Energy Logo Services, and all data, material,
