in real-time from 1Worldsync for publishing purposes to meet EU regulations and to educate
shoppers regarding energy-efficient products in select qualifying product categories.

DataSource Subscription Requirement

For Clients wanting to receive structured EU energy content in their DataSource Feeds and/or for
Clients that desire us to build and deliver EU energy content for Non-stocked
SKUs, Client must have an active DataSource Subscription or DataSource Content Creation
and Delivery Subscription in order for 1WorldSync to perform this service. The deliverables for
1WorldSync’s EU Logo Service will be subject to the Subscription
Configuration of the Client’s DataSource Subscription or DataSource Content Creation and
Delivery Subscription (i.e. markets, languages, categories, maximum number of Products/SKUs
covered, etc.).

Permitted Usage

1WorldSync’s EU Energy Logo Service may be used and published on websites fully owned and
controlled by Client, as listed in the Permitted Usage section of the Order Form.

Client Responsibilities

Client will implement 1WorldSync’s real-time JavaScript code onto their Product Page, and in
other locations on the Permitted Usages as required. Client shall provide 1WorldSync with the
Manufacturer Part Number, Manufacturer Name, and other information as required for each Product
to display the available EU Energy data from the 1WorldSync Logo service.

1WorldSync Responsibilities

Based on values passed within Client’s implementation of the real-time JavaScript code and
1WorldSync’s proprietary technologies and know-how, 1WorldSync will use commercially reasonable
efforts to provide the 1WorldSync EU Energy Logo Service. 1WorldSync will aggregate and prepare
the energy efficiency data available from Manufacturers and the EPREL database within 1WorldSync
database for a qualifying Product within the Market in the form of the 1WorldSync EU Energy Logo
Hover Window which will automatically display the applicable 1WorldSync EU Energy Label when a
user interacts with the 1WorldSync EU Energy Logo and the 1WorldSync Product Fiche or EPREL
Product Information Sheet where applicable. The 1WorldSync EU Energy Logo Services will be
provided when (i) the Products selected by Client and available on the Client Permitted Usages
meet the criteria of the EU Energy Regulations, 1WorldSync EU Energy Logo Service and (ii)
1WorldSync has energy efficiency data and product information readily available within the
1WorldSync database for the European markets.

1WorldSync Review

Client acknowledges and agrees that 1WorldSync does not intend to, and will not be required to,
edit, or review the 1WorldSync EU Energy Logo Service deliverables (i.e. the 1WorldSync EU
Energy Logos and the 1WorldSync EU Energy Labels) for accuracy, sufficiency or compatibility
with any regulations, laws, directives, governmental guidelines. 1WorldSync will use
commercially reasonable efforts to update the 1WorldSync EU Energy Logo Service and deliverables
(i.e. the 1WorldSync EU Energy Logos and the 1WorldSync EU Energy Labels) based on changes made
to the EPREL database and/or based on supplier submissions and data feeds, and the availability
thereof.

Reporting

Upon Client reasonable request, 1WorldSync will provide a report reflecting the following metrics
for the previous month: (i) the number of 1WorldSync EU Energy Logo impressions per Client
Permitted Usage; (ii) the number of resulting 1WorldSync EU Logo Hover Windows per Client
Permitted Usage; (iii) statistical information on the amount of time users interact with the
1WorldSync EU Energy logo Hover Window (“1WorldSync Report“), and (iv) the
attribute coverage rates for the 1WorldSync EU Energy Label, 1WorldSync Product Fiche, and EPREL
Product Information Sheet.

Restrictions on the Use

Client shall use the 1WorldSync EU Energy Logo Service in accordance with any applicable
manufacturer or governmental/regulatory entities guidelines at all times, and Client is solely
responsible to obtain and abide by such guidelines.

Client use of the 1WorldSync EU Energy Logo Service is intended for Client internal business
purposes only (i.e. inclusive of use on Client websites as listed in the Permitted Use section
of the Order Form, and strictly limited to the 1WorldSync EU Energy Logo Service and display of
1WorldSync EU Energy Logo, 1WorldSync EU Energy Logo Hover Content, and 1WorldSync Product Fiche
on Client Permitted Usages.

Client shall not license, sublicense, sell, resell, transfer, assign, distribute or otherwise
commercially exploit or make available to any third party the 1WorldSync EU Energy Logo Service,
the 1WorldSync EU Energy Logo Hover Content, the 1WorldSync Product Fiche or the 1WorldSync EU
Energy Logo in any way.

Client shall not modify or make derivative works based upon the 1WorldSync EU Energy Logo
Service, the 1WorldSync EU Energy Logo Hover Content, the 1WorldSync Product Fiche or the
1WorldSync EU Energy Logo or attempt to reverse engineer the 1WorldSync EU Energy Logo Service.

Data

By using the 1WorldSync EU Energy Logo Service, Client agrees that 1WorldSync may use cookies,
web beacons or other technologies to collect data related to a- user’s behavior on Client
Permitted Usages. Client grants 1WorldSync a non-exclusive, perpetual, worldwide, and
irrevocable right and license to collect, use, create derivative works from, and disclose data
derived from the 1WorldSync EU Energy Logo Services and to allow 1WorldSync third-party data
partners to do the same. In addition, 1WorldSync may use the data provided by Client, including
Brand, manufacturer part number and other attributes to create – deliverables as required under
this Agreement. Client agrees to obtain all rights and permissions necessary, if any, including
making any notifications to its users as may be necessary, for 1WorldSync and its affiliates to
monitor the Permitted Usage in order to collect and use data, create reporting based on, or
monitor website traffic, statistics, advertisements, “click-throughs” and/or other activities,
and 1WorldSync and its affiliates may use cookies, web beacons, and other technologies to
compile and use anonymous statistics about Client’s users.

1WorldSync Energy Logo Service
Termination. Upon termination of the Agreement for any reason, Client
shall cease all uses of the 1WorldSync EU Energy Logo Services, and all data, material,
deliverables provided under this Agreement.
